Terms of Service Agreement

Effective Date: Date of Payment Issued

Parties:

This Agreement is made effective as of the date of payment issued by and between the Client (hereinafter referred to as “Client”) and Sunshine Capital, located at 1702 N Woodland Blvd Ste 116605, DeLand, FL 32720 (hereinafter referred to as “SC”).

Services and Scope:

  1. Description of Services:
    • Upon enrollment, SC will provide financial coaching services which may include:
      • Financial analysis to evaluate the Client’s current financial situation.
      • Development of savings and investment strategies.
      • Identification and prioritization of personal and financial goals.
      • Assistance in finding credentialed third-party experts if needed.
    • Note: Services may vary per client request. SC does not guarantee the outcome of the Client’s success but will assist in devising a plan for financial stability.
  2. Payment for Services:
    • Client agrees to pay SC and/or third-party referrals for the coaching services provided.
  3. Client Obligations:
    • Notify SC immediately upon receipt of any correspondence concerning unsecured debt or any matter related to this Agreement.
    • Inform SC of any material changes in personal life, income, or finances.
    • Respond promptly to SC’s communications.
  4. Termination:
    • By Client: Client may terminate this Agreement at any time in writing. If terminated within 5 business days, a full refund will be issued unless services have been rendered.
    • By SC: SC may terminate this Agreement if Client fails to fulfill obligations, breaches warranties, or for other good cause. If terminated within 5 business days, a full refund will be issued unless services have been rendered.
  5. Relationship of Parties:
    • SC provides financial coaching services and is not a law firm or financial institution. Additional services will incur additional charges approved by the Client prior to incurring the fee. SC will not represent or defend Client in legal proceedings.
  6. Confidentiality:
  • SC agrees to keep Client’s information confidential and not to use it for personal benefit. This confidentiality obligation continues after termination of this Agreement.
  • Client agrees not to divulge any proprietary information, strategies, or business practices of SC. This includes, but is not limited to, any methods, processes, or business models used by SC in providing financial coaching services.
  • Both parties acknowledge that a violation of this confidentiality provision may cause irreparable harm, and the offended party shall be entitled to appropriate equitable relief, including, without limitation, injunctive relief.
  1. Representations and Warranties:
    • SC warrants it can enter this Agreement without any conflicting obligations.
    • Client warrants they have the authority to engage SC, and all information provided is true and accurate.
  2. Severability:
  • If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
  1. Governing Law:
  • This Agreement shall be governed by the laws of the State of Florida.
  1. Refund Policy:
  • Clients may request a refund within 5 business days of signing unless services have been rendered. If a refund request is made after 5 business days, SC holds the right to refuse the refund.

Payment Non-Dispute Acknowledgment:

Client agrees not to initiate a stop payment order or a credit card chargeback for any payments made to SC. If a stop payment order or chargeback is initiated, Client agrees that SC may reverse the order and will be responsible for all costs and expenses incurred by SC in challenging the order or chargeback.

Acknowledgment:

By making a payment, the Client acknowledges they have received all products, merchandise, and services associated with this Agreement. The Client agrees to pay according to the Card Issuer Agreement.

Browsewrap/Clickwrap Agreement:

By making a payment, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Agreement. Your use of SC’s services and your payment constitute your acceptance of this Agreement in its entirety. If you do not agree to these terms, do not proceed with the payment or use of SC’s services.
